Art Commission Terms of Service
General Information

By ordering a commission you agree to these terms of service I have the right to refuse a commission for any reason
By ordering a commission you declare you are of legal age.
I have the right to alter my Terms of Service at any time. New rules will not apply retroactively and won’t influence orders made before rule change.
Rights
I as an artist retain all rights to created artwork. I reserve the right to repost, use and sell created art in digital or physical forms. Profits will not be shared.
Commissioners may repost art at will as long as credit to an author is included and no profit is being made.
I do not claim any rights to third party intellectual properties or their associated characters if used in the commission.
The commissioner does not have legal copyrights over the commissioned images, however, every commissioner has the possibility of buying full commercial rights to commissioned artwork. Details will be discussed individually. Please expect industry rates and legal contracts.
Artist
I have the right to refuse a commission and I’m not obligated to state my reasoning.
Commissions will be worked on in an order of my choosing. Commissioners may message me to request a specific deadline before the initial quote (but requesting does not guarantee I will be able to meet your deadline and may impact pricing of the quote).
I have the right to copy, redistribute, post, etc. my works that I have made to promote myself. If the commissioner is not comfortable with my posting art I have made in my portfolio, etc, they can contact me.
I have the right to adjust my prices as I see fit. Prices set during sales will be during the time window I set them. Outside of sale time, prices will be adjusted according to time, materials and effort for the given piece.
If I find someone has edited my works: flipped it, traced it, copied it, and/or stolen it, I will ask for it to be taken down -- unless it was part of the commission or under the commissioners approval.
Openings and Ordering
Each quote is tailored to fit an individual commission, if you wish to get a quote, please contact me in any of the places listed above.
Quotes can be requested at any moment, outside of commission opening as well. Quotes expire after 3 months.
Commission description should include visual reference and brief description. Poetry and prose will not be accepted as reference material.
References should be concise, up to date, and written in the English language. Any changes outside of the initial project and quote must be discussed and additionally approved. Changes may be individually charged depending on their complexity.
By providing me with references for your commission you declare that you have full copyrights or the owner’s permission for usage of the character design depicted on those references.
Content
What I can do:
Artworks related to the styles I emulate
Provide drawings in a timely order and if needed within a set deadline
Traditional and digital artworks
What I won’t do:
Anything hateful or that I find offensive to a specific group/person/religion/animal/etc.
Creation Process, Revisions, Deadlines
I will provide various stages or works in progress, mostly in a location convenient to the commissioner (twitter, email etc) unless the commissioner wishes otherwise. The commissioner can also message me for updates on the status of their commission.
Most commission types will receive a sketch stage for approval and right to revision. If there is no revision/sketch stage, it will be explicitly mentioned in the commission type description.
It is the Commissioner’s responsibility to approve the sketch or to ask for revisions.
Revisions are considered a major alteration of the initial sketch.
Once the piece is inked (Line Art Phase), I will ask the commissioner for approval of the piece(s) and any changes they may want made.
Upon completion, any changes to the commissioned works will be very difficult. I will be able to do minor changes like colour changes, but anything beyond must be discussed with me. Final edits and adjustments are welcome, but not included in the initial quote. If revisions are outstanding or major, they will result in an extra charge.
Any additional work outside of the initial project can be refused, or will be quoted and charged for accordingly.
Turnover will depend on the complexity and amount of pieces commissioned. Larger graphics may take 1-2 months depending on complexity.
Payment and Refunds
Payments will be made via paypal, commissioners will provide an email for the invoice.
A 50% deposit is expected upon quote acceptance, unless a payment plan has been discussed and written down explicitly with the commissioner.
All invoices are due 7 days from receiving them, unless agreed otherwise. Invoices past due will be cancelled and the commission associated with it cancelled as well.
Paid work will be top priority to me, however it will be worked on in the order I see fit depending on current commissions.
Any payment issues should be discussed with me prior to completion of the commission.
Further work will not begin until the commissioner has approved the sketch phase.
The commissioner will not receive their finished commission unless it is fully paid for.
The commissioner should communicate all deadlines and/or sense of urgency clearly and as soon as possible. I am not responsible for any lack of communication regarding deadlines.
If I cannot work on the commission for any reason, the commissioner will be issued a full refund.
Refunds may be requested at any part of the process, however if it is after work has started they will be partial refunds depending on how much work has already been done on the piece(s)
The commissioner has a right to cancel at any point.
Once the commission is finished, delivered and the commissioner is satisfied, no refunds will be issued.
Other
Please respect that I have my own working hours and I will not be sharing my schedules.
Commissioner understands that when a commission is accepted by both parties that I may stream progress of the commission on my twitch streams (twitch.tv/ozfiz). If the commissioner does not wish for their piece to be worked on, on stream, they are free to discuss this with me.
